Effect of the new laws
The new legislation grants a wider range of qualifying Non-Profit Organisations (NPOs):
Exemption from income tax and other specified taxes; and a more limited category will be eligible for this
Tax deductibility of donations made by South African tax paying donors.
Aim of the Workshop
The workshop is aimed at introducing and discussing these new provisions of the Income Tax Act and amongst its objectives are the following:
To demystify NPO Taxation and Related Laws;
To disseminate information on the Tax Laws Amendment Act 30 of 2000;
To look at the implications of the Amendments;
To consider practical application of the Legislation and the Amendments;
To introduce the NPO Tax Communications and Support NPO Services Programme, as funded; and
To identify issues for advocacy around recent amendments to the Income Tax Act.

About the Presenters
The workshop will be facilitated by Karen Nelson who is the Senior Lobbyist and Researcher for the Non-Profit Partnership and Ricardo Wyngaard who is currently coordinating the NPO Tax Communications and Support Services Programme and is currently with the Legal Resources Centre.
Ricardo Wyngaard completed his B. Proc. LLB degree at the University of the Western Cape. During 1996 he was appointed as candidate attorney in Caledon at the firm of Bosman & de Villiers in terms of the Overberg Pilot Project, which was a joint-initiative between the Legal Aid Board and Lawyers for Human Rights. The project was aimed at promoting access to justice in the rural areas.
He was admitted as an attorney during May 1998 and during November 1998 he started his employment as a Project Implementer within the Security of Farm Workers Project at Lawyers for Human Rights. He resumed employment in the Nonprofit Organisations Legal Support Project at the Legal Resources Centre during November 2000.
Karen Nelson graduated in 1993 with a BA LLB from the University of Cape Town and in 1994 completed the Certificate in Legal Practice, followed by a Post-graduate Diploma in Tax Law in 1995. During 1998 she worked as a candidate attorney in Cape Town for Jan S De Villiers Attorneys; she was admitted as an attorney in February 1999.
In 1999 Karen was awarded an LLM (Commercial Law) degree. Her dissertation focused upon the taxation of NPOs, and this secured her interest in tax and the voluntary sector. She joined the Non-Profit Partnership in March 2000 as a researcher/lobbyist working specifically on the Tax Campaign.
